Bankstown Local Environmental Plan 2001 is Council's main planning control for development in the City of Bankstown. The LEP provides objectives, zones, and core development standards such as floor space ratios, densities, and minimum widths at the front building line.

Bankstown Development Control Plan 2005 supports the LEP by providing additional objectives and development standards to enhance the function, appearance, and amenity of development in the City of Bankstown. The development standards include height, setbacks, urban design, amenity, landscaping, and access.

Section 94 Contributions Plans and Planning Agreements Policy enable Council to require development to make a monetary contribution for the provision of public services and amenities. There are currently four Section 94 Contributions Plans that apply in the City of Bankstown.

The legal framework of the NSW development system requires a development application to comply with the Environmental Planning and Assessment Act 1979, Environmental Planning and Assessment Regulation 2000, and other regulatory instruments such as State and Regional Plans, BASIX, and the Residential Flat Design Code. The Bankstown Development Engineering Standards ensures the quality and maintenance of infrastructure is consistent with the future needs of the City's built environment, and may require a development to consider stormwater drainage, stormwater easements, driveways, and footpath crossings.

Policy for the Commercial Use Of Council Footways (824k)
The Commercial Use Of Council Footways Policy 2006 outlines the application requirements for use of the public footpath for commercial purposes such as outdoor dining and cafes, display of goods for sale, and A-Frame type advertising. Included in the policy is Council's responsibilities in allowing use of the footpath, in terms of community expectations, urban design standards and public access within the current legal environment. It is important that you read this policy should you be considering using public footways for a commercial or non commercial purpose.
