What is a Development Application (DA)?

A Development Application (DA) is a formal request for permission to carry out "development". "Development" includes:

  • the erection and/or alteration of a building or structure;
  • any work in, over, or under land;
  • the use of land or a building; and
  • the subdivision of land

All such work requires a Development Application unless it is listed as "exempt development" or "complying development" under the provisions of Bankstown Local Environment Plan 2001 and Bankstown Development Control Plan 2005


How do I lodge a Development Application?

This flow chart provides a general outline of the various steps to lodging a development application with Council. You should check with Council if there are any other steps that may be relevant to your application:


Step 1: Obtain a Section 149 Certificate

You should obtain a Section 149 Certificate from Council. These certificates contain important information about your land, such as zoning and policies that may apply to the land.

Step 2: Check the relevant codes and policies

You must check the relevant State Government and Council planning controls that apply to your land prior to proceeding with developing a proposal for the land. To find out more, visit the link to Planning and Building.

Step 3: Read 'Development Assessment: A Guide'

You should read this document to identify potential issues that can be dealt with prior to lodgement to make your application proceed quicker. It also contains a checklist on the level of information required for your application depending on the type of development you propose.

Step 4: Attend the Major Development Design Assessment Panel

Mixed commercial/residential development, residential flat buildings, and major non-residential development must be referred to Council's Major Development Design Assessment Panel prior to lodgement. Fees for this service are applicable.

Step 5: Complete the relevant application form

You will need to find out which type of form to complete, either a Development Application form, a Combined Development Application and Construction Certificate form, or a Complying Development Certificate form.

Step 6: Lodge your application

It is best if you come into Council to lodge your application to make sure that all the information you need to supply has been provided. Council will only accept applications that are complete. Application fees must be paid upon lodgement. You will obtain a receipt that has the application number on it that can be used for later enquiries.

The main DA fee that Council charges is set by State Government regulation. There are a number of other fees set by Council that apply to DAs. Fees set by Council are reviewed annually, placed on public exhibition, and then adopted by Council.
